Inspector finds 42 violations at Fairborn rink

A State Fire Marshal’s inspector found 42 violations at Skyborn Skateland on Wednesday.

A series of infractions were discovered at the longtime roller skating rink, 5309 Haddix Road, ranging from misuse of extension cords and blocking of exits because of snow piles to failing to have an occupancy certificate, according to a report obtained by WHIO-TV.

The State Fire Marshal’s office told News Center 7’s Andy Sedlak the business should not have been operating without the occupancy permit.

But Greene County’s chief building official, Al Kuzma, said the business was operating legally.

“Our building department was created in 1959, and this structure predates that,” he said. Occupancy permits were not required when the business opened, he said.

“They’ve been operating legally; they just were grandfathered in, so to speak,” Kuzma said.

Officials said the business owners are working to obtain an occupancy permit and according to a report from the fire marshal’s office, the business should remedy the other infractions within seven days.

The fire marshal’s inspection was triggered by earlier investigations by the Greene County Combined Health District, which discovered three dogs, two mattresses and a television stored in a room.

“We received a complaint from an individual back on Feb. 2,” said Deborah Leopold with the health district. . “The complainant alleged that someone was living there.”

According to Leopold, Skyborn Skateland removed the dogs, mattresses and TV prior to a follow-up inspection.

“They have been cooperative with us,” she said.

Erica Collins, who is acting as the business owner, denied that anyone lived at the business. She also said the establishment expects to be open Friday.
