Ohio Governor Mike DeWine announced Tuesday that the state is asking that more than 160 prison inmates be released or considered for early release.
The move come as the state is grappling with how to keep prisoners and prison staff protected from the spread of coronavirus.
“Finding inmates to release from prison to create more social distancing is frankly not easy,” the governor said. “We have around 49,000 people in prison today, and each one of them is there for a reason. Murderers, sexual predators, people like them we are not going to let out.”
There are two groups the governor is trying to have removed from prison. The first group involves 141 minimum security inmates who were due to be released before July 13th.
The governor is asking that the 141 inmates be released under legal provisions for overcrowding relief, a move that requires action from the Correctional Institution Inspection Committee. Ohio state house and senate members are part of the CIIC.
The other group of prisoners include 26 inmates who are over the age of 60 and have at least one chronic health condition. These inmates have all served at least 50% of their sentence. By law, the governor cannot quickly commute their sentences. Instead, there is typically a 60-day waiting period for notifications.
“We are asking judges and prosecutors across Ohio who are associated with these individuals to waive the 60-day notices so we can take these cases to the parole board.” The parole board is prepared to meet starting Friday. The parole board must meet for each individual case of the 26 inmates. Victims in these cases will also be given notice, and will be able to have their voices heard before the inmate is released.
The governor says the parole board can impose new restrictions on inmates being released, and that the governor can also add restrictions on anyone released early.
The governor says they are not asking for anyone to be released who has been convicted of crimes including sex offenses, homicide-related offenses, kidnapping, ethnic intimidation, terroristic threats or domestic violence. Also excluded are those who have been denied judicial release in the past, have previous incarcerations, are multi-state offenders, have warrants or detainers, or have serious prison rule violations in recent years.
The moves Tuesday come after Governor DeWine on Monday ordered 26 Ohio National Guard members to deploy to Ohio’s only Federal prison to assist with coronavirus cases there.
