Troy daycare is the focus of 3 investigative agencies amid sex abuse allegations

A Troy daycare worker left his job in handcuffs Monday, accused of inappropriately touching a 10-year-old girl.

Andrew T. Cain, 35, who works at JJJ Childcare, is charged with gross sexual imposition, a felony. He has since been released from the Miami County Jail after posting a $25,000 bond, ordered to not have unsupervised contact with children, court records show.

Now, Troy police say they've identified at least three other possible victims, and News Center 7's John Bedell has uncovered the daycare is the focus of three investigative agencies: the Troy Police Department and the Miami County and Ohio Departments of Job and Family Services.

“We’ve got the right agencies involved that are making sure that the childcare facility is safe,” Troy police detective Capt. Jeff Kunkleman said.

In court documents tied to Cain’s case, Troy police wrote they uncovered more allegations of inappropriate touching, and said it appeared the facility “was not reporting the accusations as required by state law.”

An Ohio Department of Jobs and Family Services spokesperson said on Tuesday that JJJ Childcare did not report the Troy police investigation involving Cain, and that the state department has opened its own investigation.

Cain worked at the facility as a bus driver, maintenance person and as an assistant at times.

Troy police call logs for JJJ Childcare, 840 Arthur Road, show since 2013 officers responded six times for child abuse complaints. However, police records did not indicate whether any of the complaints were substantiated.

Inspection records from the Ohio Department of Job and Family Services show the state has found an number of concerns at the facility over the years.

In February 2018, after a child’s finger was closed in a restroom door while kids were playing near the restroom, the state found the facility “did not protect or remove children from a situation and/or person determined to be unsafe.”

The state also said parents were not given reports the day of incidents involving their kids, which is required by state rules.

Another inspection by the state showed that children were “exposed to inappropriate language; conversation; behavior; by a staff member.”

And another inspection of the childcare center came after someone complained that parents were not notified when children were exposed to communicable illnesses.

The records also show the state says JJJ Childcare addressed each of the incidents mentioned and became fully compliant.

JJJ Childcare owner Jack Cain, who is Andrew Cain’s father, declined comment other than to say the accusations are not true.
