Dayton man indicted in death of accomplice

DAYTON, Ohio — A Dayton man has been indicted in connection with a robbery that left one man dead.

Robert A. Brooks, 32, was indicted in connection with the robbery that happened on Oct. 4, 2020. Montgomery County Prosecuting Attorney Mat Heck, Jr., said Brooks and another man, Kato Knight, 20, approached a man who was sleeping inside a vehicle.

Authorities said the two planned on robbing the man, but when the victim woke up, he pulled out his own firearm and shot at the two men in self-defense. Knight was shot and killed during the exchange of gunfire.

Brooks was indicted on four counts of murder, two counts of felonious assault, two counts of aggravated robbery and two counts of having weapons under disability.

Authorities said under Ohio law, an individual is responsible for any death that occurs during a robbery attempt, including the death of an accomplice.

Brooks was previously convicted in a number of other cases. He is being held in the Montgomery County Jail on a $1 million bond and is scheduled to be arraigned on Oct. 20.
