Juvenile Court Judge Julie Bruns announced she plans to keep a 15-year-old in custody as her case moves forward.
Police believe a group of teens passed the weapon around and recorded themselves.
Officers believed the 15-year-old girl pointed the gun at Smith and fired, hitting him in the chest.
In a shocking move in court, the girl’s mother told the judge that the victim’s mother was sitting right next to her.
“She would never intentionally kill my baby,” Smith’s mother said.
The sobbing woman told the judge her son, and the girl accused of shooting him were raised together.
She said the 15-year-old was her god-child.
“Nobody to hug her and let her know we’re here, not mad at her, and know that this was an accident,” Smith’s mother said.
The two mothers told the judge they’d been best friends for 20 years and believed the 15-year-old girl was no threat and should be immediately released on home detention.
The judge said she still had questions and wasn’t ready to take that step.
“But right now, I just don’t have enough information to feel comfortable releasing her,” Bruns said.
