CENTERVILLE — The City of Centerville is appealing a recent court decision allowing the construction of a Sheetz in the city.

As News Center 7 reported last week, a Montgomery County Common Pleas Court judge reversed the Centerville City Council’s decision to deny Sheetz construction on Far Hills Avenue. The location is the current site of Elsa’s restaurant.
Now the city is seeking a review and reversal by the Second District Court of Appeals.

Judge Angela Jackson said in a decision filed last week that the council overstepped its authority by making a decision that went against the commission’s approval.
A spokesperson for the city said the decision to deny to proposal was “based on the finding that the Sheetz development is inconsistent with the use and character of surrounding properties.”
They claim the current ruling “challenges the city’s ability to enforce the standards of the Unified Development Ordinance (UDO) and and safeguard the interests of its residents, institutions and businesses.”
“This is not just about one project—it is about maintaining our ability as Centerville’s elected representatives to make decisions that reflect and protect the values and priorities of our community. We will continue to advocate for Centerville’s residents and the principles that guide our development policies and will appeal the incorrect decision of the trial court,” Mayor Brooks Compton said.
