CENTERVILLE — A judge has ruled in favor of Sheetz’s construction plans in Centerville.

As News Center 7 previously reported, Centerville approved Sheetz’s plan to build on Far Hills Avenue in late August 2023, but people brought up concerns. The city reversed its decision in October, which led Sheetz to sue the city the next month. On Tuesday, a Montgomery County Common Pleas Court judge sided with Sheetz.
Now, Sheetz has the green light to build a gas station and convenience store at the current site of Elsa’s Restaurant, but city leaders are not happy with the decision.

As shown on News Center 7 at 5:00, Centerville Mayor Brooks Compton released the following statement on the ruling:
“City Council is extremely disappointed in the Court’s decision and will meet soon with its legal counsel to evaluate next steps. City Council’s decision to deny the proposed development reflected the City’s longstanding responsibility to balance development with preserving the unique qualities that make Centerville a desirable place to live and work. City Council’s denial was recognition that the proposed development does not align with the use and character of the surrounding neighborhood or the standards established in the City’s Unified Development Ordinance.”
City officials also emphasized that they have the ability to appeal.
News Center 7′s Amber Jenkins reached out to the owner of Elsa’s about the development in the case, but they were unavailable. Despite the restaurant’s possible closure, some patrons said they’re looking forward to a Sheetz.
