Coroner rules on boy’s death at Dayton pool, family working with city’s legal department

DAYTON — The 6-year-old boy who died after being pulled from the City of Dayton’s Lohrey Pool in July died as a result of drowning, according to the official ruling from the Montgomery County Coroner’s Office.

Niguel Hamilton’s death had previously been listed as pending by the coroner’s office.  Hamilton’s death was considered an accident, the coroner’s office said.

Hamilton was pulled from the indoor pool at the Lohrey Recreation Center in July and later died at the hospital.

"It is too early to have details on the events of that night, but it is our commitment to the family and the community that this work will be thorough and complete,” Mayor Nan Whaley said in July following the drowning.

City of Dayton officials said the investigation has not finished when asked for an update Friday.

The family retained the services of an attorney following the drowning as they search for answers into their son’s death.

“We remain deeply saddened by the death of 6-year-old Niguel and believe his drowning could have been prevented with proper attention by the staff on duty,” said Michael Wright and Ben Crump, the attorneys representing Hamilton’s family. “While we cannot bring young Niguel back, we will continue to pursue every avenue of justice for the family of Niguel Hamilton.”

The attorneys said they are staying in close contact with the City of Dayton’s legal department and “have not yet decided whether a lawsuit will be filed.”
