UPDATE: Dayton man indicted in deadly December shooting on Leo Street

DAYTON — UPDATE @ 4 p.m. (Jan. 7 (2021):

Tyray Ward was indicted on two counts of murder and three counts of felonious assault, according to the Grand Jury report.

Arraignment has been set for January 12.

UPDATE @ 7:25 a.m. (Jan. 5, 2021):

A Dayton man accused in a deadly shooting in December is in custody after a warrant was issued for his arrest last week, according to online jail records.

Tyray Ward, 26, was arrested by Dayton police Monday and booked into the Montgomery County Jail, according to records.

Ward was charged last week with murder and felonious assault, stemming from the deadly shooting of Austin Newell on Leo Street Dec. 11.

Additional details about the arrest were not immediately available.

Investigators accuse Ward of firing multiple shots into the car that Newell was a passenger in. Newell fell out of the car and was found dead on Leo Street.

The driver of the car, identified by police as Damon Ellis, is facing unrelated felony charges stemming from a child endangering case the day after Christmas.

FIRST REPORT (Dec. 31, 2020):

An arrest warrant has been issued for a Dayton man police said shot a man inside a car, before the man was found dead on Leo Street earlier this month.

Tyray Ward, 26, of Dayton, was charged Wednesday on two counts of murder and three counts of felonious assault.

Police said Ward fired multiple shots into the car Austin Newell was riding in on Dec. 11. Newell was found dead on Leo Street around 11:30 p.m.

Police said Newell fell out of the car that he was in that was being driven by another man. The driver of the car, Damon Ellis, is facing unrelated felony charges stemming from a child endangering case the day after Christmas.

Surveillance video showed the deadly shooting happened and through police reports, interviews and 911 calls, police said Ward was identified as the suspected shooter in the homicide case.
