UPDATE: Ex-UD student who hid camera in campus bathroom was cheerleader at university

Dieter Spees

DAYTON — A former UD student will have to spend 180 days in jail after he hid a camera in a University of Dayton bathroom, recording seven different victims.

Dieter Spees, 22, pleaded guilty to a bill of information on charges of voyeurism and possessing criminal tools. Due to COVID-19, Spees will be on electronic home detention until a probation officer determines it is safe for Spees to report to jail, records show. He will receive jail time credit for the days served while on home detention.

The camera was hidden in the bathroom on the second floor of the Roesch Library on Oct. 28. It was disguised to look like a pen on the floor next to a toilet, according to a UD police report.

Spees was a member of the university’s cheerleading squad, but was not active during the 2019-20 academic year, the university said in a statement.

Supplemental reports from the University of Dayton revealed there were seven victims in the case, including four females and three males.

As part of the investigation, UD police searched a laptop belonging to Spees and discovered nearly 500 videos and photos, mostly from the Roesch Library, but also including some from private home bathrooms. It’s not clear in the report where the private home bathrooms were located.

“UD Police conducted an exhaustive examination — including hiring a specialized cybersecurity consultant — of materials found on his devices, and found hundreds of still images and videos that appear to have been taken without the other person’s consent,” UD’s Chief of Police Savalas Kidd said. “As part of this analysis, the forensic consultant worked to determine whether images or videos may have been uploaded to the internet or shared with others, and did not find evidence that images had been shared.”

“The investigation could not determine when most of the images were taken, whether the locations were on campus, or the identities of the individuals,” Kidd said.

As part of his sentence, Spees is not allowed to enter any UD buildings or property and must also complete sex offender treatment and/or mental health treatment. He also must register as a Tier I sex offender.

As part of his up to five years of community control sanctions, Spees is not allowed to possess any handheld device with audio or video recording capability, including a cell phone. He also cannot have access to any electronic device with internet capability.

If Spees violates his community control sanctions he will have to serve another 360 days in jail, court records show.
