“As you can imagine this is a horrifically tragic event,” Michael Wright said.

Wright is a Dayton lawyer whom the family of Palmer contacted to help them navigate this difficult time in their life.

Ta’Wayne Palmer Sr., 49, was driving seven of his children, grandchildren and their friends back home from a family outing on New Year’s Day.

“They were doing what families do on holidays, be together and spend time together,” Wright said.

Deputies said that another SUV came into Ta’Wayne’s lane and hit him head-on.

Wright said the terrible crash should have been avoided and echoed what deputies said about the suspected at-fault driver.

“You have a drunk driver going left of center and killing this family,” Wright said.

Ta’Wayne was trapped in the car and died from his injuries.

The crash also took the lives of 9-year-old Octavious Palmer and 13-year-old Ta’Wayne Palmer Jr.

Journie Palmer, 7, is in critical condition at the hospital.

All three children are Ta’Wayne Sr.’s children.

The four other children riding in the SUV have been treated and released from the hospital.

The 43-year-old driver of the other SUV is at the hospital under the deputy’s supervision.

The Palmer family while in shock and grieving is also looking to protect their future legal rights.

“It’s absolutely senseless, we believe it is senselessness and it could have been avoided,” Wright said.

Deputies continue to monitor the condition of the child that is still in critical condition.

They are also gathering evidence and waiting for the results of the blood alcohol level testing as they prepare to present the facts of the case to prosecutors for potential charges.
