Grand jury indicts Huber Heights man who shot at police during pursuit

Adam Cottrill, the Huber Heights man police said shot at them during a pursuit in late September, has been formally charged by a county grand jury on several felonies from that incident.

A Montgomery County grand jury on Wednesday returned a multiple-count indictment accusing the 26-year-old of the following:

* Felonious assault with a deadly weapon against a peace officer (three counts)

* Failure to comply with the order or signal of a peace officer (one count)

* Vandalism (one count)

The felonious assault counts include three-, five- and seven-year firearm specifications for discharging a firearm from a motor vehicle and for discharging a firearm at a peace officer.

According to the county prosecutor's office, Riverside officers on Sept. 29 were dispatched to the Kroger on Spinning Road on a report of a man with a firearm. When they arrived, they were told the suspect -- later identified as Cottrill -- was in the Yum Yums Drive-Thru, across the street.

When the officers arrived, Cottrill backed out of the drive‐thru and fled. The Riverside officer activated his lights and sirens in an attempt to get the defendant to stop. Instead, Cottrill proceeded to lead officers on a pursuit through numerous neighborhoods, narrowly avoiding other vehicles.

During the pursuit, Cottrill pointed a semi‐automatic firearm and fired multiple times at the pursuing officers, striking one the Riverside cruisers three times, including the windshield.

The pursuit entered Dayton, where Cottrill lost control of his vehicle at Burkhardt and South Garland avenues and crashed in a wooded area.

He ran but was quickly taken into custody.

Cottrill, in the county jail on a $500,000 bond, is on community control sanctions after he was convicted in December 2018 of aggravated drug possession.

He is to be arraigned Nov. 5, according to the prosecutor's office.
