Teen robbery suspect shot by off-duty officer could face adult court, judge says

MIAMISBURG — UPDATE @ 1:41 p.m. (Feb. 6):

The 17-year-old shot by an off-duty officer after police said he was attempting to carjack people in the area of I-75 and Ohio 725 appeared in juvenile court this afternoon.

The suspect appeared before Judge Anthony Capizzi wearing a sling over his right arm.

Capizzi said prosecutors plan to file a transfer request to move the teen’s case to adult court.

The judge said the teen had no previous record, but his age would make his transfer to adult court mandatory if probable cause is found that the teen committed the crimes.

The teen was ordered to stay in custody at the juvenile detention center after Capizzi said the accusations against him were too serious to release him.

Capizzi said the teen is accused of firing a weapon, putting "hundreds of lives at risk."

The teen’s attorney had asked for him to be released with electronic monitoring.

Police said the teen’s gun was found at the scene and was loaded at the time, according to a statement from Miamisburg Police.

INITIAL REPORT:

A 17-year-old who was shot by an off-duty Miami Twp. police officer as he attempted to carjack people in the area of I-75 and Ohio 725 Monday is scheduled in court Tuesday afternoon.

The teen is scheduled for an initial appearance before Judge Anthony Capizzi at 1:30 p.m., court administrators said.

The suspect was shot at least once by the off-duty officer around 2 p.m. after the suspect pointed his gun at the officer, said Sgt. Paul Nienhaus with Miami Twp. Police.

Jackson Twp. Police Chief Jon Schade and one of his sergeants, Sgt. Mark Bruner, were taking one of their police cruisers to a mechanic shop in Centerville, when they came upon the suspect attempting to carjack vehicles in the area and alerted dispatchers to the incident, the chief said.

Schade said Bruner was running toward the suspect, when the off-duty officer fired his weapon after the suspect pointed his gun at the off-duty officer.

The shooting happened shortly after the teen was said to have robbed the Shell station on the corner of Byers Road and Ohio 725, Nienhaus said.

The suspect was treated and released from the hospital and is in custody at the Montgomery County Juvenile Detention Center.
