LORAIN, Ohio — An Ohio prosecutor decided not to charge a police officer who shot a break-in suspect in early October.

Lorain County Prosecutor J.D. Tomlinson found the officer did not use excessive or unreasonable force in shooting the suspect, CBS affiliate WOIO reported.

At 12:05 a.m. Oct. 7, police received a call from a resident saying they saw a man breaking into a vehicle in the 1300 block of W. 17th St.
The 911 caller reportedly thought they saw a gun in the suspect’s hand.
Upon arrival, officers said they made contact with the suspect in the driveway, but they fled on foot between the houses, WOIO reported.
Officers saw a gun on the suspect and after a short foot chase, one officer fired several shots, striking the suspect, according to Lorain Police Lt. Morris.
After receiving first aid from police, the suspect was taken to Mercy Hospital of Loraine where they were treated for multiple gunshot wounds.
The suspect was identified as 26-year-old Dustin Lee Terry. Terry reportedly had a getaway driver, a 28-year-old woman, who was detained.
Terry had just finished a year-long ‘good behavior’ sentence at midnight on Oct. 7, five minutes before the 911 call was placed, WOIO reported.
No officers were injured. Lorain Police asked Elyria Police to handle the investigation.
