Police called when dispute about potholes leads to blocked driveway

There is a dispute developing about potholes in a driveway off Old Troy Pike that leads to the Baymont Inn & Suites in Huber Heights.

The dispute affected the public Thursday evening when the inn's owner used his car to block entrances to two businesses that use his driveway for their patrons.

Baymont Inn owner Khalid Chaudhry said the property, in the 8100 block of Old Troy Pike, he has owned the last 10 years includes the driveway that leads to the inn as well as Osaka Japanese Steakhouse and Panera Bread.

Chaudhry said that according to the property contract, each business should put in their fair share to pay for pothole repairs or damage.

The driveway that leads to these businesses has many potholes in it, and for the last two years, Chaudhry claims to have made several attempts to get the people who own and operate the Panera store to help pay for driveway repairs.

Chaudhry said the people who own and operate the Panera have said they would help, but then never did. Panera needs to pay its fair share, he said, mainly because most of the traffic running through the driveway goes to Panera.

The manager at the Panera declined comment on the issue tonight when contacted by WHIO-TV.

Chaudhry said Osaka's owner told him that he and his landlord would meet with Chaudhry on Monday about the dispute.

Huber Heights police were dispatched when patrons complained about not being able to get to Panera or the inn.

"I just wanted to eat at one of the restaurants," said Amber Simmons, who called our newsroom about the blocked driveway off Old Troy Pike. She said she and her family eventually were able to get to the Panera.

A police sergeant said the police department would not become involved because the dispute is a civil matter.

Police were able to get Chaudhry to move his car for tonight, but he said he will says continue to park there until this dispute is resolved.
