5 Middletown officers not charged for standoff in April where shots were fired

Five Police officers will not face charges for firing shots in Middletown that wounded a man during a standoff last month.

A Butler County grand jury declined to indict the officers on Tuesday, according to our news partner WCPO in Cincinnati.

News Center 7 previously reported a person was critically injured after gunfire was exchanged between officers and a male suspect in Middletown on April 24.

Butler County Sheriff’s Office and a mental health crisis team were called to the apartment complex to reports of a 29-year-old man experiencing a mental health crisis, according to Daniel Hils, president of Front Line Advisors which represents Middletown police.

Ohio BCI was also at the scene.

The sheriff’s office requested Middletown police’s SWAT team after the man was seen with a handgun, according to Hils.

SWAT attempted to talk down the suspect but Hils said the man expressed he was suicidal and the conversation was mostly incoherent.

The man then fired at least one shot at officers and they returned fire hitting the man, Hils said.

Medics transported the man to the hospital, a BCI spokesperson said.

The suspect, Kyle Kellum, 29, is facing a felonious assault charge and is currently in the Butler County Jail, according to online jail records.

No officers were injured in the incident.
